Oculus Start Terms and Privacy Policy

OCULUS VR, LLC (“Oculus”)

CONSUMER DISCLOSURE GUIDELINES

We hope you enjoy the developer kit with gifts (the “Gifts”) you have received or will be receiving soon. We are providing these Gifts to you free of charge with no expectation of anything in return. The Gifts are for your own personal use only. You may not sell or transfer the Gifts to any third party, including as a prize or giveaway, without the express, written permission of Oculus. Should you choose to post a photo or video that features any Oculus products or Gifts (the “Review”), including on any blog, website and/or social media channel, please abide by the following guidelines:

  1. Your Review must be truthful and not misleading or deceptive. Your Review must reflect your honest opinion(s), finding(s), belief(s) and experience(s) based on your personal use or experience with the Oculus product.
  2. In order to comply with the obligations set forth in the Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising, your Review must contain a disclosure of the fact that you received the Gifts free of charge from Oculus (the “Disclosure”). Such Disclosure must be prominent, clear and conspicuous and communicated in a way that your followers are likely to notice and understand. Consider font size, color, location and terminology. For example, your Disclosure should be in legible font size and color, located in close proximity to the Review and readily viewable (e.g., it should not be located at the bottom of your post or buried in your web site’s terms of use, in a pop-up window, or via hyperlink). It doesn’t have to be complicated – it should just be straightforward and up front. Here are a couple of examples of how this Disclosure can be made very easily and simply:
    • “I accepted a free Oculus Start Dev Kit from Oculus in connection with my post/review.”
    • “Thanks Oculus for the free Oculus Start Dev Kit and I think...”
    • “This post is sponsored by Oculus.”
  3. For space-constrained social media channels (e.g., Twitter, Instagram), you should include an abbreviated form of Disclosure in the same post as your Review. For example, by including “#Sponsored” or “#Ad” immediately before or after the Review.
  4. If you do decide to post a Review, we’d love to see it! Please #OculusStart or send a link to your Review to oculusstart@oculus.com once your Review goes “live”.
  5. By posting a Review, you agree that Oculus (and its affiliates, subsidiaries, successors, assigns and licensees) has the right to link to, re-publish, share and/or use your Review, or any part thereof, in any manner and media, throughout the world, in perpetuity and may (but is not obligated to) attribute the Review to you (by using your name, or username) and/or the site(s) or platforms on which it was posted. If your Review includes references to or images of third parties or content provided by third parties, you represent and warrant that you have all necessary permissions from such third parties to permit Oculus to use such references, images and/or content as described in the preceding sentence.
